ACLU Urges SCOTUS to Halt Deportations Under Trump’s Alien Enemies Act
The ACLU has filed an emergency appeal with the U.S. Supreme Court, arguing that the Trump administration is violating court orders and due process by fast-tracking the deportation of Venezuelan migrants under the Alien Enemies Act of 1798. The ACLU contends that migrants are being given less than 24 hours' notice—often in English only and without attorney notification—before deportation to a notorious Salvadoran prison, denying them adequate opportunity to seek judicial review. The Supreme Court had previously ordered that detainees must be notified and allowed reasonable time to challenge their removal, but the ACLU alleges the administration is circumventing these requirements by shuffling detainees between jurisdictions and providing inadequate notice. Government officials maintain the right to remove people but have not denied plans to resume deportations. The ACLU warns that these actions amount to removing individuals to potentially abusive conditions without trial or meaningful recourse. The Supreme Court has issued an emergency order temporarily blocking deportations pending further review.
