Judge Finds York County Landfill Liable for 419 Clean Water Violations

A federal judge has ruled that Modern Landfill in York County violated the Clean Water Act 419 times between July 2019 and April 2023, resulting in potential penalties that could reach $4.1 million. The violations included the release of harmful pollutants, such as PFAS 'forever chemicals,' into Kreutz Creek, which feeds into the Susquehanna River. The Lower Susquehanna Riverkeeper Association filed the lawsuit, asserting that the landfill's actions have severely impacted local residents and aquatic life. While Republic Services admitted to these violations, it proposed a significantly lower penalty of $570,000. The judge's decision means that further proceedings will determine the final penalties, with a teleconference scheduled for May 21 to discuss next steps.
